One of the biggest circumstances that should be assessed before removing a child from guardianship is the condition of living that the child is currently in. The major reason why children are removed from their parents is that they are unable to provide a suitable living condition for the child. Therefore, when assessing whether the child is living in suitable conditions that aid his physical and mental well-being. This rule applies regardless of whether the parent is doing this willingly or unwillingly. For example, when the parent is poor and cannot provide well for the child leading to a situation where the child cannot be adequately taken care of, then the state may decide to take the child away from the parent. Another situation is in the event of abuse, where the parent is physically, verbally, or emotionally abusive towards the child. The child’s welfare in this situation is in jeopardy and this forces the removal of the child from the parent (Zeanah & Humphreys, 2018).
Another situation that is considered is the parent’s history. If the parent has a history of violence towards children, then having children live with him is a serious risk. For the safety of the children, it is much better if the child is kept away from the parent and this leads to the removal of the child from their parents.
